BALCH from an earlier photo IMMUNITY Continued from Pg. 1, Sec. 2 numbers at the time federal agents staged the June raid. Knox said Williams offered him $50 a week to operate the wheel. In response to McSoud's questions Knox said he used gambling equipment a and workers which were "already there." He said the "shakes" were held at "different houses and we paid the people who were down and out or didn't have any work." The fee for such a service was $10, he said.

Knox testified his application for a federal wagering listed 623 E. Latimer St. as his "place of business," but never actually conducted gambling activities at that address. He said he had two drawings or "shakes" a day and that any profits were given to Williams. Knox said Williams also gave him money, if needed, to make payoffs to winners.

When Knox began his testimony attorney Ed Parks, who represents Knox in a civil matter, objected to the "line of testimony" expected to come from Knox because it might incriminate his client in another court. Judge Barrow ordered the jury from the courtroom. At that point McSoud, Malloy and Judge Barrow became entangled in a discussion about immunity. McSoud said he had promised Knox immunity or freedom from prosecution as far as the district attorney's office was concerned for his testimony before a recent grand jury. Immunity Asked Malloy contended Knox's mony might cause charges to be brought against the witness in state court and suggested an attorney be appointed for Knox.

McSoud asked the court to grant immunity which would apply to other courts. After the jury returned Knox testified he met Williams two times a day either at the Williams grocery, 504 E. Apache St. or the Williams home across the street, 511 E. Apache St.

Knox said no "shakes" were ever made at the store or house. Knox identified "proof "hit slips" and other forms used in the numbers operation. Under Malloy's cross examination Knox said he took over the policy wheel operation from Bob Collins and that as a painter Knox visited the Williams store and home. Statement Offered Malloy also produced a sworn statement taken in the lawyer's office which Knox admitted signing. The statement contradicted much of Knox's earlier testimony.

However, additional questioning by McSoud, brought statements by Knox that he was "not telling the truth" in the written statement and signed the document because "Al was my friend." Knox said he did not know he was under oath when making the statement in Malloy's office although he admittedly signed the document two times. Judge Barrow recessed the session and testimony will resume at 9:30 a.m. with Knox still in the witness chair. HOLDUP SUSPECTS WAIVE HEARINGS A man and woman arrested as suspects in a holdup waived preliminary hearings in Common Pleas Court Monday and were bound over to District Court for trial on charges of armed robbery. Charles Pollock, 21, who gave his address as 14335 E.

12th and Pamela Brouillet, 23, Anchorage, Alaska, are charged with the holdup last week at the QuikTrip Grocery at 7509 E. Pine St. were arrested after a poofficer en route to the store after the robbery was reported saw the suspects' car run a stop sign. He pursued the car and Pollock and Miss Brouillet were arrested after the police cruiser crashed into their car and disabled it.
