    Funeral Disputes - The Burial and Cremation (Scotland) Act 2016The 2016 Act introduced a 'priority list' of those who are responsible for organising a deceased's funeral. This applies where funeral instructions are not left or they are impractical.Following high profile and long running cases of funeral disputes (https://lnkd.in/dQijHBd9) the legislation was introduced to deal with situations where there was ambiguity as to who should make the decision.The legislation however only deals with the funeral and not the funeral service. There is also still room for dispute - siblings who disagree, spouse vs cohabitant.s.65 deals with the death of an adult and s.66 with the death of a child. Let's focus on s.65:Definition of an Adult: An adult, in this context, refers to a person who has reached the age of 16 or older.Responsibility for Arrangements: When an adult dies, the responsibility for making arrangements for their burial or cremation rests with certain individuals in a specified order. (a)the adult’s spouse or civil partner,(b)neither married to nor in a civil partnership with the adult but was living with the adult as if they were married to each other and had been so living for a period of at least 6 months (or if the adult was in hospital immediately before death had been so living for such period when the adult was admitted to hospital),(c)the adult’s child,[...]The first person with the responsibility is stated to be the deceased's spouse or civil partner, if one exists, and they are willing and able to act. Thereafter a partner (living as if married for over 6 months) could act and if there is no partner then the child would have responsibility. If there is more than one person in each class they both rank equally.The Act does not discriminate between half-blood relatives or step-children. They are to be treated as equal to full-blood and children.Consultation with Family: The person responsible for making arrangements would be wise to consult with the deceased's close relatives, if possible, regarding the arrangements to be made. This consultation may involve discussing the deceased's wishes, religious or cultural considerations, and any other relevant factors.Consideration of Wishes and Views: The person making the arrangements must take into account any wishes expressed by the deceased before their death when making decisions about the burial or cremation.Disputes: If there is a dispute among the deceased's close relatives regarding the arrangements to be made, the matter may be referred to a Sheriff for resolution.For further specialist advice on funeral disputes please contact .
